MAJOR CRIME (INVESTIGATIVE POWERS) ACT 2004 (NO 79 OF 2004) - SECT 76

Protection of Director etc.

    (1)     For section 86J(2) and (3) of the Police Regulation Act 1958 substitute

    "(2)     No civil or criminal proceedings may be brought against a person referred to in sub-section (1) in respect of any act of a kind referred to in that sub-section without the leave of the Supreme Court.

    (3)     The Supreme Court may not give leave unless it is satisfied that there is substantial ground to believe that the person to be proceeded against has acted in bad faith.".

    (2)     For section 86J(5) of the Police Regulation Act 1958 substitute

    "(5)     A person referred to in sub-section (1) may not be called to give evidence in any court or in any legal proceedings or before the Appeals Board in respect of any matter coming to his or her knowledge in the exercise of functions under this Act.".

    (3)     Section 86J(6) and (7) of the Police Regulation Act 1958 are repealed .
