Archaeological and Aboriginal Relics Preservation Act 1972 - SECT 29

Evidentiary

29. Evidentiary

In any proceedings for an offence against this Act-

   (a)  a certificate signed by the Minister to the effect that a person named
        in the certificate is the Secretary or is an inspector or warden shall
        be prima facie evidence of that fact;

   (b)  a certificate signed by the Minister administering the
        Aboriginal Lands Act 1991 to the effect that any land is Crown land
        shall be prima facie evidence of that fact;

   (c)  a certificate purporting to be signed by the Director of the Museum of
        Victoria to the effect that an item is a relic shall be prima facie
        evidence of that fact;

   (d)  a certificate signed by the Minister to the effect that no consent
        under section 21(2) has been given in a particular case shall be prima
        facie evidence of that fact;

   (e)  a certificate purporting to be signed by the Secretary to the effect
        that no consent under section 26A(1) has been given in a particular
        case shall be prima facie evidence of that fact; and

   (f)  a certificate purporting to be signed by the Secretary to the effect
        that no consent under section 26B(1) has been given in a particular
        case shall be prima facie evidence of that fact.
