Exemptions

6. Exemptions



(1) The following classes of sales are exempt from the operation of the Act-

   (a)  the sale at a public auction of a motor car owned or used by a council
        within the meaning of the Local Government Act 1989;

   (b)  the sale at a public auction of a motor car owned by the executor or
        administrator of the estate of a deceased person;

   (c)  the sale at a public auction of a motor car-

   (i)  that at the time of the auction is damaged, if the reasonable cost to
        repair the damage would be more than $3000 or exceed the value of the
        motor car; and

   (ii) that is owned by a person who carries on the business of insuring
        motor cars if the motor car is sold in the course of that business.

(2) James Equipment Pty Ltd ACN 120 745 851 is exempt from the operation of
the Act.
