ENDANGERED SPECIES PROTECTION ACT 1992 No. 194 of 1992 - SECT 172

172. (1) In this section:

"acquisition of property", and "just terms", have the same meanings as in
paragraph 51 (xxxi) of the Constitution.

(2) If, apart from this section, the operation of this Act would result in the
acquisition of property from a person otherwise than on just terms, the
Commonwealth is liable to pay reasonable compensation to the person.

(3) If the Commonwealth and the person do not agree on the amount of the
compensation, the person may apply to the Federal Court to determine a
reasonable amount of compensation.

(4) The Lands Acquisition Act 1989 does not apply to an acquisition of
property that results from the operation of this Act.
