Search warrants
183 Search warrants
(1) An investigator may apply to an issuing officer for the issue of a search
warrant for premises if the investigator believes on reasonable grounds-- (a)
that a provision of this Act or the regulations is being or has been
contravened on the premises or in the community to which the premises are
related, or
(b) that there is on the premises evidence of a contravention of
this Act or the regulations.
(2) An issuing officer to whom an application
for a search warrant is made under this section may, if satisfied that there
are reasonable grounds for doing so, issue a search warrant authorising an
investigator named in the warrant and any other person named in the warrant--
(a) to enter the premises concerned, and
(b) to search the premises for
evidence of a contravention of this Act or the regulations.
(2A) A police
officer may accompany an investigator who enters premises and searches for
evidence under a search warrant as if the police officer were named in the
warrant.
(3) Division 4 of Part 5 of the Law Enforcement (Powers and
Responsibilities) Act 2002 applies to a search warrant issued under this
section.
(4) In this section--
"issuing officer" means an authorised officer within the meaning of the Law
Enforcement (Powers and Responsibilities) Act 2002 .
