94 Applications to Tribunal by residents for breaches
(1) A resident of a community may give a written notice (in the approved form,
if any) to the operator to take action for the remedy of a breach of a
community rule by any person within a specified period of at least 30 days.
(2) If it appears to the resident that the breach has not been remedied within
the 30-day period, the resident may, within a further period of 30 days, apply
to the Tribunal for orders under this section.
(3) The Tribunal may, on
application under this section and if it considers the breach is in the
circumstances sufficient to justify its doing so, make either or both of the
following orders-- (a) an order requiring compliance with the rule within a
specified period,
(b) any ancillary order that the Tribunal, in the
circumstances, thinks appropriate.
