RESIDENTIAL (LAND LEASE) COMMUNITIES ACT 2013 - SECT 95
Applications to Tribunal about community rules
(1) A resident or operator of a community may apply to the Tribunal if there
is a dispute about whether-- (a) a community rule complies with this Part, or
(b) the procedure for making or amending a community rule has been correctly
followed.
(2) The Tribunal may, on application under this section, make one
or more of the following orders-- (a) an order amending or setting aside the
community rule,
(b) an order modifying the operation of the community rule in
its application to some of the persons to or in respect of whom the rule
applies,
(c) an order upholding the community rule,
(d) any ancillary order
that the Tribunal, in the circumstances, thinks appropriate.
(3) The Tribunal
may make an order staying the time when a community rule takes effect pending
its decision whether to make an order under subsection (2).
(4) In this
section--
"community rule" includes-- (a) a proposed community rule, and
(b) an
amendment or proposed amendment of a community rule.
