(1) The Chief Health
Officer may resign from that office by writing signed and given to the
Minister.
(2) The resignation
takes effect on the later of —
(a)
receipt by the Minister; or
(b) the
day specified in the resignation.
(3) A person vacates
office as the Chief Health Officer if the person ceases to be —
(a) a
departmental officer; or
(b) a
medical practitioner.
(4) The Minister may
remove a person from the office of Chief Health Officer on any of these
grounds —
(a)
mental or physical incapacity;
(b)
incompetence;
(c)
neglect of duty;
(d)
misconduct.
(5) The removal of a
person from office under subsection (4) does not by itself affect the
person’s employment as a public service officer.
(6) Subsection (4)
does not limit the application of the Public Sector Management Act 1994 Part
5 to and in relation to any person who holds or has held the office of Chief
Health Officer.
